Terms of Use

1. Who this is for

Graph Tracer Full Edition is licensed to one teacher for in-class use with that teacher's students, up to 35 students. It is not a school-wide or district license. A second teacher needs a second subscription.

You must be able to form a contract. If you are using Graph Tracer for a class at a school, you are responsible for following your school's rules on student information and approved tools.

2. Accounts and sign-in

Teachers sign in with Google. Use a Google account you control. Use the same address at checkout that you use to sign in so we can attach your subscription to your account.

You are responsible for activity under your account. Keep your Google account secure. Tell us if you think someone else used it.

3. Free try and paid Full Edition

Free try. A new teacher who signs in with Google may use one linear graph, for one teacher and in-class use with up to 35 students, at no charge. No card is required to try.

Full Edition. The paid subscription unlocks all fifteen graphs for one year. The current price is $39.99 per year, billed by Stripe, unless a posted coupon applies (including FIRST50 while that offer is open). We may change the price for future terms. The price in effect when you subscribe or renew is the price you pay for that term.

Upgrade. Inside the app, "Get all 15 graphs" starts Stripe checkout or the customer portal. When payment succeeds, we mark your account active through the period end date Stripe reports.

After a paid term ends. If the subscription expires and is not renewed, that account does not return to free-try status. You may sign in and resubscribe. You may not start a new free try on that same account.

We may limit abuse of the free try (for example automated account creation). We may suspend an account that violates these Terms.

4. Payment, taxes, cancellation

Payments are processed by Stripe, Inc. We do not store full card numbers. You authorize Stripe to charge the payment method you provide for the annual term and for renewals until you cancel.

If sales tax applies, Stripe may add it at checkout based on the information you and we have provided. You are responsible for amounts charged, including tax.

Cancel anytime in the Stripe customer portal or by emailing us. Cancellation takes effect at the end of the current paid term. You keep paid access until that date.

Except where the law requires otherwise, the current term is not refundable after checkout. If we have to cancel the Service for everyone, we will refund a pro-rata share of an unused paid term.

5. License and intellectual property

We own Graph Tracer, including the software, graphs, text, marks, and design. We grant you a limited, non-exclusive, non-transferable license to use the Service during your free try or paid term, for the classroom purpose above.

You may not copy, sell, scrape, reverse engineer, or offer Graph Tracer as your own product. You may project or share a live class session with your students. You may not republish the graph library as a separate worksheet pack or competing app.

Traces you or your students create ("Class Session Content") and the aggregate scores for Class Session Content stay yours (or your school's). You grant us a license to host and display Class Session Content only as needed to run the Service for you.

6. Student information

Student personal identifiable information (PII) is not captured in GRAPH TRACER. Students access the solution via anonymous links that expire at the end of class. Scores recorded in the class sessions are reported in aggregate to the teacher for each class session, assuming more than one student participated. No individual student information is retained.

We use Class Session Content and student information only to provide Graph Tracer to your class. We do not sell it. We do not use it for advertising. We do not use it to train a general-purpose model. See the Privacy Policy for how to delete a class session.

If your school needs a data-processing addendum, email us. A standard teacher purchase does not by itself create a district contract.

7. Acceptable use

Do not:

• Try to access another teacher's classes, rosters, or traces.
• Probe, overload, or break the Service.
• Use bots to create accounts or harvest data.
• Upload malware or illegal content.
• Collect student emails or extra identifiers the product does not need.
• Use Graph Tracer to market to students.

We may suspend or close an account that violates this section.

8. Third-party services

Sign-in is provided by Google. Payment is provided by Stripe. Their terms apply to those steps. We are not responsible for an outage or policy change at Google or Stripe.

9. Disclaimer

Graph Tracer is a teaching aid. It does not replace your professional judgment, your curriculum, or your school's required tools. THE SERVICE IS PROVIDED "AS IS." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR CLASS TIME, ARISING FROM THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR GRAPH TRACER IN THE TWELVE MONTHS BEFORE THE CLAIM, OR $39.99 IF YOU WERE ON A FREE TRY AND PAID US NOTHING.

Some states do not allow certain limits. In those states, our liability is limited to the maximum extent allowed.

11. Indemnity

You will defend and hold us harmless from claims that arise from your misuse of the Service, your Class Session Content, or your handling of student information, except to the extent a claim is caused by our willful misconduct.

12. Termination

You may stop using Graph Tracer at any time. We may suspend or terminate access if you breach these Terms, if payment fails, or if we discontinue the Service. On termination we may delete Class Session Content after a reasonable period, except where we must keep a record of the transaction.

13. Governing law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Courts located in Fulton County, Georgia, will hear disputes, unless applicable law requires otherwise.
